Our Privacy Policy

Our Sites may contain links to third-party websites, products and services. This privacy policy only applies to our Sites and our collection and use of your information. The linked websites, products and services of third parties, and their collection and use of your information, are governed by the privacy policies of such third parties. 1. Information We Collect 

We do not require you to provide us with personally identifiable information in order to use our Sites. However, if you choose to participate in certain activities offered on the Sites (such as surveys and grocery list building and sharing), we may ask you to provide us with what is generally called "personally identifiable" information (such as your name, email address, postal mailing address, and home/mobile telephone number, etc.). In addition, you may have the option of providing us with certain demographic information about yourself or your household (such as age, gender, household income, interests, zip code, and state). There may be other occasions not specifically identified in this Privacy Policy when we may ask you to provide us with personally identifiable information. However, it will always be your decision whether to provide us with your personally identifiable information. In some cases, if you decline to share such information with us, then we may not be able to provide you with certain services. There are different ways in which we may collect information when you interact with our Sites.  Many are discussed below, but in general we may collect information when you:

• View, print, download, save, and/or display coupons.
• Redeem coupons.
• Register with us or our Affiliates.
• Use our Sites to create and sync shopping lists.
• Interact with advertisements on our Sites.
• Communicate with our customer service team for support.
• Participate in certain programs, offers, and promotions.
• Use our referral service to tell your friend(s) about our coupons.
• Invite others to share your shopping list.
• Register a retailer loyalty account or similar retailer identifier with us.
• Register or interact with us via Facebook Connect or other social media provider.

Additionally, when you download and install our coupon printing software, toolbar, or mobile applications on your computer or other device, we collect information about that device that helps us manage our products and services and detect and prevent coupon fraud. A device identifier stays on your computer even after uninstalling the coupon printer software. This identifier is used solely to prevent coupon fraud and does not collect personally identifiable information.

Cookie & Web Beacon Information: When you visit the Sites, we may send one or more cookies – a small text file containing a string of alphanumeric characters – to your computer. We use both session cookies and persistent cookies. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Sites. These persistent cookies can be removed, but each web browser is a little different. Please review your browser’s Help menu to learn how to modify your cookies setup. Our Sites also use web beacons (also known as clear gifs or pixel tags), which are tiny graphics with a unique identifier that are placed in the code of a webpage.

Affiliate Cookies: Cookies sent to your computer by us, or our Affiliates on our behalf, are governed by this Privacy Policy. The independent use of cookies by our Affiliates is not covered by this privacy policy, as we do not have access or control over such cookies.  Generally speaking, such cookies are used by Affiliates to provide you with customized advertising. To learn more about cookies and how to manage them, please consult your browser's help menu. Automatically Collected Information: When you use the Sites or open one of our emails, we use technology (including web beacons and cookies, IP addresses, unique device IDs, user IDs, and log files) to automatically collect non-personally identifiable information including:

• Coupon activity (including requesting, printing, and saving to a loyalty account).
• Application activity (such as searches performed and features accessed).
• Web browser type.
• The website that referred you to us.
• The web pages you viewed on the Sites.
• The advertisements you viewed and clicked on the Sites.
• The dates and times that you visited the Sites.

We may link automatically collected information to personally identifiable information you submit while on the Sites when you are logged in or in connection with a service you have requested. For example, if you sign up for our Grocery iQ application, we will store your user ID together with your email address so that you can manage and (if you chose to) share your shopping list.

Tell-A-Friend: If you choose to use our referral service to tell a friend about our coupons, we will ask you for your friend’s name and email address. We will use the information you provide to automatically send your friend a one-time email inviting him or her to view the coupon you recommended. We delete the email address shortly after fulfilling your request and do not share it with any third party.

Lists & List Sharing: If you use our Grocery iQ mobile application, or our Grocery iQ website, we will collect and store for you the items you put on your list. We also may use that information to serve you tailored advertising, coupons or other content. For instance, if your list includes baby food, we may present you with a coupon or advertisement from us or an Affiliate for baby food or related items, such as diapers. If you choose to invite someone to share your shopping list, we will ask you to provide us with that person’s email address in order to send them your invitation. We store this information in order to administer the list sharing feature, but we do not share it with any third party. 

Location Information: Use of the Sites, including our mobile applications, may include location-based services. If you use those services, we may receive information about your location which we may use to send you geographically relevant promotions or advertisements.

Analytic Tools: We may use tools such as Google Analytics to better understand who is using our Sites and how they are using them. These tools use cookies to collect information such as time of visit, pages visited, time spent on each page of the website, IP address, and type of operating system used. We use this information to manage and improve our Sites. You can learn how to opt-out of Google Analytics tracking software here.

Promotions, Sweepstakes, & Contests: From time to time, we may sponsor sweepstakes, contests, other promotions or surveys. Personal information may be required as a condition of participation for purposes of verifying entrants' identities, notifying winners and fulfilling prizes. We will not use or disclose any such information unless we receive your consent to do so. If we engage a third party to assist us in administering a promotion or fulfilling prizes, this information will be disclosed to that third party.

Data Retention: We retain all information we collect about you for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

2. How We Use Your Information

We use all of the information that we collect from your use of the Sites, any information you provide when you register with us, and information provided to us by third parties as described below.  The following are the ways we use information we collect:

• Process and record coupon requesting and redemption activity.
• Manage and store shopping lists.
• Monitor the effectiveness of marketing campaigns.
• Aggregate usage metrics (such as total number of visitors to the Sites and pages viewed, application usage and downloads, and interaction with advertisements).
• Understand usage trends and preferences.
• Improve the way the Sites work and look.
• Improve our marketing and promotional efforts.
• Provide you with a personalized experience on the Sites (such as recognizing your system so that you will not have to re-enter information during your current or future visit to the Sites).
• Provide you with custom, personalized coupon promotions and advertisements on and off our Sites.
• Create new features and functionality.
• For other non-marketing or administrative purposes (such as customer service purposes).
• We also may use the device information to provide targeted ads to you based on your printing and redemption activity.

3. When We Share Information

Personally Identifiable Information: We do not share personally identifiable information with our Affiliates or other third-parties for their marketing or promotional uses except as part of a specific program or feature that you have chosen to participate in. For example, we offer coupons on our Sites that require you to fill out an advertiser survey in order to receive the coupon. If you choose to participate in the survey, then we will share the information you provide with the advertiser who provided the survey. You may be given the option to register with the website of one of our Affiliates, or sign up for an Affiliate’s newsletter. If we manage the website for the Affiliate and you choose to register or sign up with that Affiliate, then we will share the information you provide with that Affiliate. In addition, we may use your personally identifiable information for the purpose of obtaining associated non-personally identifiable information from third parties, but we do not permit those third parties to use your personally identifiable information for any purpose other than providing us with associated non-personally identifiable information.

Non-Personally Identifiable Information: We aggregate non-personally identifiable information (such as age, gender, household income, interests, zip code, state, coupon print and redemption data, and other automatically collected information that does not personally identify you) and share such aggregated information with our Affiliates in order to help them improve the marketing of their products and services. We may also share such non-personally identifiable information with our Affiliates when you interact with our promotional content on their websites. An Affiliate may match the non-personally identifiable information we provide with personally identifiable information you have previously provided to that Affiliate. For instance, if you have signed up for a loyalty account from one of our Affiliates, such as a grocery retailer, and request that our coupon be saved to that loyalty account, we will provide the Affiliate with the coupon and other information necessary to fulfill your request. The Affiliate will then match the information with your loyalty account which may contain your personally identifiable information. We also may share such non-personally identifiable information with third-party ad servers, ad networks, and data exchanges (“Ad Partners”) so that they can tailor their advertisements to your apparent interests and deliver those advertisements to you while you are either on our Sites or on third-party websites. For example, if you print pet food coupons, then an Ad Server may conclude that you have a pet and display a pet care supply advertisement instead of a random advertisement. In addition, Ad Partners themselves use technologies (such as cookies, pixels, and beacons) to collect information about your browsing behavior on our Sites which they may match with information they have previously collected (including personally identifiable information you have provided to them). However, we do not share personally identifiable information with Ad Partners, and we do not permit Ad Partners to collect personally identifiable information about you on our Sites. Exceptions: We may share information about you if required to do so by law or in the good-faith belief that such action is necessary to comply with local, state, or federal laws or to respond to a court order, judicial or other governmental subpoena or warrant, or in the event of bankruptcy proceedings. We also reserve the right to share information that we believe, in good faith, is appropriate or necessary to take precautions against liability, protect us or our Affiliates from fraudulent, abusive, or unlawful uses, investigate and defend ourselves against any third-party claims or allegations, assist government enforcement agencies, protect the security or integrity of the Sites, and to protect our rights, property, or safety and those of our Affiliates and others. 

In the event that we are acquired by or merged with a third-party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from you as part of such merger, acquisition, sale, or other change of control.

4. Your Choices

If you are registered with us, you may modify, correct, or delete your personally identifiable information and preferences at any time by going to the Member Center on our website or by contacting us. We will respond to you within 30 days from the date you contact us.

To protect your privacy and security, we require you to enter your email address and password before allowing access to your account on the Member Center.

If you no longer wish to receive weekly coupon email alerts and other special offers from us you can opt-out by either following the instructions included in each email, changing your preferences in the Member Center on our website, or by contacting us. 5. Facebook Connect

You may be given the opportunity to register with us via Facebook Connect. We will collect and store the information you provide us through Facebook Connect (including personally identifiable information) with any other registration information you provide us. Disabling your Facebook Connect may not terminate your account with us.

6. Community Forum

We may ourselves manage and operate a discussion board or other forum (“Community Forum”) within the Sites, or use a third party hosted and managed site, for general matters of interest regarding our coupons and Sites or special programs we offer. The use of any Community Forum feature on our Sites is subject to the forum rules posted on the Community Forum site, and the use of a Community Forum on a third party site will be subject to that third-party site’s forum rules. Please take special note that if you post any personally identifiable information to a Community Forum, then that information can be read, collected, and used by other users of the Community Forums. This Privacy Policy does not apply to the personally identifiable information you post to a Community Forum, and we are not responsible for any use of information you post to a Community Forum, whether hosted by us or a third party.

8. Our Commitment To Children’s Privacy

Protecting the privacy of young children is especially important. 1. Introduction

Impact Radius, Inc. (a California company, with a place of business at 10 East Figueroa, 2nd Floor, Santa Barbara, CA 93101) ("Impact Radius," "we," "us" or "our"), operates and uses the website atwww.impactradius.com (the "Website") to offer access to an advertising tracking platform (the "Platform") related to online and offline performance advertising.

2. Who may use our Website?

Although certain areas of the Website can be accessed by visitors generally, access to our Platform is not provided to the general public. Only persons or entities that are eligible to enter into further agreement(s) with us may access non-public areas of our website (our "Advertisers" and "Media Partners"). All such Advertisers and Media Partners must be corporations or other legal entities or adults (at least of the legal age to be able to enter into contracts in the jurisdiction in which they reside). Further, Impact Radius reserves the right at its absolute discretion to refuse to provide access to the Platform to anyone for any or no reason. 

3. Who uses personal data?

We do not gather information about or from visitors to or users of the public areas of our website solely as a result of such visits or usage. We only gather such information from Advertisers and Media Partners whom we engage in a business relationship and who enter into a user agreement with us. Accordingly, not all of this Privacy Policy applies to all visitors to this website. With respect to each of our Advertisers and Media Partners' privacy policies, and any non-related site that is linked to from within our website, please contact the owner or operator of each such site directly for their privacy policies.

4. Scope and Effective Date

This Privacy Policy is effective as of March 1, 2010 and covers how and for what purposes personal data is collected by Impact Radius.

5. No Personal Data of General Visitors Collected at or by This Site

This site neither requires general visitors to this website to submit personal data, nor does this website collect personal data about general visitors that the visitors do not voluntarily submit themselves. If you do not log into our website, purchase services at our website, or submit the Contact Us form on our website, our web server does not have access to personal data about you. We do not know your email address unless you volunteer it.

6. Collection and Use of Non-Personal Data

(a)     Passive Browser Information

Passive Browser information is collected by the web server hosting the Website. This server logs standard information communicated by web browsers as they make requests to the server, including:

• The URL of the actual request

When you submit the form on the Contact Us section of our Website or make a purchase, the information we collect about you may include your name, company name, contact information, profile and preference information.

This contact information (whether or not including personal data) may be used by us to:

(ii)   administer and support your interaction with our website;

(iii)  deliver you with access to our Platform;

(iv)   contact you again about other services and products we offer and information on upcoming Impact Radius events;

We may outsource some of these activities to our business partners. To the extent we do, we shall use our reasonable efforts to ensure that our business partners will only process your personal data on terms similar to those set out in this Privacy Policy.

We reserve the right to retain and use your contact information as long as we deem necessary to communicate with you and preserve or disclose your contact information as reasonably necessary to comply with our contractual obligations to you and applicable privacy and/or data protection legislation.

(c)     Collection and use of email addresses

We collect the email addresses of those who communicate with us by email. Generally, the email addresses we collect are used to contact existing or potential business customers for the purpose of providing services, information and assistance. We may use the email address to contact existing or potential business customers to introduce new products or services, provide notification of website changes, or provide general business information. If you contact us through the Contact Us form, we reserve the right to retain and use the email address and contact information as long as we deem necessary to communicate with you and preserve or disclose your information as reasonably necessary to comply with our contractual obligations to you and applicable privacy and/or data protection legislation.

If in the future you decide that you do not want us to email you regarding new products or services, provide notification of website changes, or provide general business information, please opt-out by letting us know in writing by email to privacy@impactradius.com.

7. Cookies

(a)     All visitors

"Cookies" are small text files that contain a string of alpha-numeric characters and are used to associate an action taken by a browser with subsequent actions taken by that browser. Web beacons are small strings of HTML code that are placed in a Web page, and are sometimes called "clear GIFs" (Graphics Interchange Format) or "pixel tags." Web beacons are most often used in conjunction with cookies.  

We place unique identifier cookies on the hard drives of those who sign on which are used to maintain the visitor "sign on" status for the duration of the visit, for one-time customizing/tailoring of your visit and for long-term storage of user preferences. We also use cookies to track the pages visited by a visitor so that we can deliver Impact Radius web content based on the visitor's profile (as provided by the visitor) and the visitor's past activity on the Impact Radius website.

(b)     Minors

Impact Radius does not knowingly collect any personal information about individuals under eighteen (18) years of age. If Impact Radius obtains actual knowledge that it has collected personal data about an individual under eighteen (18) years of age, that personal data will be immediately deleted from its database.

8. Security

We have implemented security measures that are amongst the industry's highest in order to protect our users' personal data, business data and financial information ("Sensitive Information") from loss, misuse and unauthorized access, disclosure, alteration or destruction. Users may be general website visitors, Advertisers or Media Partners.

When users submit Sensitive Information on the Website, their Sensitive Information is protected both online and offline. When our registration process asks users to submit Sensitive Information and when we transmit such Sensitive Information, that Sensitive Information is encrypted and protected with SSL encryption software. While we use SSL encryption to protect Sensitive Information online, we protect all other user information online and offline.

The servers that we store Sensitive Information in are kept in a secure physical environment. We have security measures in place to protect the loss, misuse and alteration of Sensitive Information under our control. Our employees are made aware of, and are accountable for compliance with, these procedures. With the exception of our technology security experts, no employee has access to back-end systems that would enable them to use (or misuse) your Sensitive Information.

We ensure that strict procedures are followed and documented when back-end systems are accessed by our technology security experts.

Please be advised that, although we take every reasonable precaution available to protect your Sensitive Information, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, we cannot warrant that your Sensitive Information will be absolutely secure. Any transmission of data at or through our Website is undertaken at your own risk. However, access to your Sensitive Information is strictly limited, and not accessible to the public. In compliance with applicable data protection legislation, we shall notify you and any applicable regulatory agencies (including the Information Commissioner) if we learn of an information security breach with respect to your Sensitive Information. Impact Radius does not rent, sell, or share personal data about you with other people or non-affiliated companies, except under the following circumstances:

• in order to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.
• when it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person; violations of Impact Radius' terms of use, any agreement with Impact Radius or this Privacy Policy; or as otherwise required by law.
• where Impact Radius determines, in its sole discretion, that such disclosure is necessary to protect the rights of Impact Radius and/or a third party, or necessary to protect Impact Radius from liability of any kind.
• if Impact Radius sells any or all of its assets or their shareholders sell any or all of their shares to a third party in which case and subject always to compliance with applicable data protection legislation, your personal data may be transferred to the buyer.
